This Returns, Withdrawal and Refund Policy applies to purchases made through PeriPerryArt, operated by:

I operate this shop as a one-person business and sell physical print-on-demand artwork and digital artwork to customers worldwide.

My physical products and artwork are produced and shipped on my behalf through Printify, an international print-on-demand fulfillment platform, and through independent print providers within Printify’s fulfillment network.

Printify and its print providers assist me with production, packaging and delivery. Your purchase contract is with PeriPerryArt, not with Printify or an individual print provider.

Nothing in this policy excludes, limits or overrides any consumer right that cannot lawfully be excluded or limited. Where mandatory consumer law in your country gives you more favorable rights than this policy, those mandatory rights apply.

1. Scope

This policy applies to:

  • physical print-on-demand products;

  • electronic artwork;

  • downloadable artwork;

  • digital prints;

  • image files;

  • templates; and

  • other digital content supplied electronically.

For the purposes of this policy, a consumer is an individual purchasing mainly for personal purposes rather than for a trade, business or profession.

2. How physical products are fulfilled

My physical products are generally made only after an order is placed.

An order may be routed to a Printify print provider located in your country or in another country. The production location may vary depending on:

  • the product ordered;

  • availability;

  • production capacity;

  • shipping options;

  • your delivery address; and

  • other operational factors.

Items from the same order may be produced by different print providers and may arrive in separate parcels or at different times.

The identity or location of the print provider does not affect your contractual relationship with me or your mandatory consumer rights.

3. Statutory withdrawal right for physical products

Where applicable law gives you a right to cancel or withdraw from an online purchase, you may exercise that right within the applicable statutory period.

For consumers in the European Union or European Economic Area, the withdrawal period is generally 14 days.

For a single product, the period begins after you, or a third party nominated by you other than the carrier, receives the product.

Where several products from one order are delivered separately, the withdrawal period generally begins after the final product is received.

You do not need to provide a reason for exercising a statutory withdrawal right.

4. Print-on-demand products are not automatically excluded

The fact that a product is printed or manufactured only after you place an order does not, by itself, automatically remove a statutory withdrawal right.

A withdrawal exclusion may apply where a product:

  • is made according to your individual specifications;

  • contains personalization selected or supplied by you;

  • contains your name, photograph, wording or other individual content;

  • is commissioned specifically for you; or

  • is otherwise clearly tailored to your personal requirements.

A standard product displaying one of my regular designs is not necessarily personalized merely because it is printed after purchase.

Where a product is excluded from withdrawal because it is personalized or custom-made, I will identify that before you place the order.

5. How to request a withdrawal, return or refund

You may submit a request through the refund, return or contact function available in my Shopify store.

For efficient processing, please include:

  • your name;

  • your order number;

  • the product concerned;

  • whether the request relates to withdrawal, damage, a defect or another issue; and

  • a clear description of what you are requesting.

A clear statement submitted through Shopify, by email or by post is sufficient to exercise a statutory withdrawal right, provided it is sent within the applicable period.

You are not required to contact me by telephone in order to exercise a withdrawal right or request a legally available remedy.

Contacting Printify or an individual print provider directly does not normally constitute notice to me.

6. Return authorization and return address

Because products may be produced and shipped from different international facilities, do not return a product to the address shown on the original parcel unless I expressly instruct you to do so.

The return address on a shipping label may belong to:

  • a Printify print provider;

  • a carrier;

  • a logistics center;

  • a warehouse; or

  • another facility that cannot process customer returns.

Contact me before returning a product. Where a physical return is required, I will provide the appropriate return instructions and return address.

Do not send a product directly to Printify or a print provider unless I give you written instructions to do so.

Sending an item to an unauthorized address may result in the parcel being rejected, destroyed, donated or becoming unrecoverable.

This does not remove any mandatory right you may have under applicable law, but contacting me first helps ensure that the return can be properly processed.

7. Returning non-defective physical products

Where you validly exercise a statutory withdrawal right, you must return the product within the period required by applicable law.

For EU/EEA consumers, the product must generally be dispatched without undue delay and no later than 14 days after you notify me of the withdrawal.

Unless applicable law requires otherwise, you are responsible for the direct cost of returning a non-defective product where:

  • you changed your mind;

  • the product was correctly produced and supplied;

  • the product corresponds to its description; and

  • you were informed before purchase that return shipping would be at your expense.

International return shipping may cost more than the original delivery charge because the return destination may differ from the production or shipping location.

8. Condition of returned products

You may inspect a product to determine its nature, characteristics and functioning in the same way that you reasonably could in a physical shop.

Where permitted by law, you may be responsible for any reduction in value caused by handling or use beyond what is reasonably necessary for that inspection.

I will not reduce a statutory refund merely because:

  • the packaging has been opened;

  • the product has been reasonably inspected; or

  • the original packaging is no longer available.

A lawful deduction may be made for actual diminished value caused by excessive use, wear, washing, staining, damage or handling.

Returned products should be securely packaged to prevent damage during transit.

9. Refunds following withdrawal from a physical-product order

Where you validly exercise a statutory withdrawal right, I will refund the payments received for the affected products.

For EU/EEA consumers, this includes the cost of the least expensive standard delivery method offered for the order.

I am not required to refund additional delivery costs resulting from your choice of:

  • express delivery;

  • priority delivery;

  • expedited production;

  • special handling; or

  • another delivery method more expensive than the standard option.

Refunds will be issued without undue delay and within the period required by applicable law.

For EU/EEA consumers, reimbursement will generally be made no later than 14 days after I receive notice of the withdrawal.

Where a physical return is required, I may withhold reimbursement until:

  • I receive the returned product; or

  • you provide evidence that the product was sent,

whichever occurs first.

Unless otherwise agreed, refunds will be issued using the original payment method.

Currency-conversion differences, foreign-exchange charges and fees independently imposed by a bank, card issuer or payment provider may not be refundable by me unless applicable law requires otherwise.

10. Damaged, defective, misprinted or incorrect products

Contact me promptly if a physical product:

  • arrives damaged;

  • has a manufacturing defect;

  • is incorrectly printed;

  • has a material print-quality problem;

  • is materially different from its description;

  • is the wrong item, size, color or design because of a fulfillment error;

  • is missing a component; or

  • otherwise fails to meet applicable conformity requirements.

Please provide:

  • your name and order number;

  • a description of the issue;

  • a photograph showing the complete product;

  • close-up photographs showing the damage or defect; and

  • photographs of the packaging or shipping label where relevant.

I ask that apparent production, printing or shipping problems be reported as soon as reasonably possible and preferably within 30 days after delivery. This helps me submit the matter to Printify or the relevant print provider.

The 30-day reporting request is an operational request only. It does not shorten or replace any longer statutory period during which you may assert rights concerning defective or non-conforming products.

11. Remedies for defective physical products

After reviewing the issue, I may provide an appropriate remedy such as:

  • a replacement or reprint;

  • correction of the order;

  • a price reduction;

  • a full or partial refund; or

  • another remedy required by applicable law.

Where permitted by law, I may first offer a replacement or reprint if that remedy can be provided within a reasonable time and without significant inconvenience.

Where replacement is impossible, unsuccessful, unreasonably delayed or inappropriate because of the seriousness of the defect, you may be entitled to a refund, price reduction, termination of the contract or another statutory remedy.

Your rights against me are not limited by the compensation, refund or reprint that Printify may make available to me under its own fulfillment terms.

12. Returnless resolutions

In many cases, Printify and its print providers assess manufacturing defects using photographs and do not require the product to be physically returned.

I may therefore instruct you to:

  • retain the product;

  • recycle it;

  • donate it;

  • safely dispose of it; or

  • take another reasonable action.

Do not send a defective product anywhere unless I provide written return instructions.

A request for photographs is intended to help verify the issue and does not remove your statutory rights.

13. Minor production variations

Print-on-demand manufacturing may result in minor variations between:

  • the product preview and the finished product;

  • different production batches;

  • different print providers;

  • screen colors and printed colors;

  • print placement;

  • print dimensions;

  • garment or product texture; and

  • the measurements of the underlying blank product.

Reasonable and technically unavoidable variations do not necessarily constitute a defect.

This does not apply where a variation:

  • is material;

  • exceeds reasonable production tolerances;

  • contradicts the product description;

  • significantly affects the appearance or use of the product; or

  • otherwise makes the product legally non-conforming.

14. Exchanges

Because products are made to order and are not held in my own inventory, I generally do not offer direct exchanges for non-defective products.

Where you have a statutory withdrawal right, you may return an eligible product in accordance with this policy and place a separate order for the replacement item.

Where the wrong or defective product was supplied because of an error attributable to me or my fulfillment providers, I will provide the remedy required by applicable law, which may include a replacement at no additional cost.

15. Order changes and cancellations before production

Print-on-demand orders may enter production shortly after purchase.

Requests to:

  • cancel an order;

  • change a size or color;

  • replace a design;

  • change personalization; or

  • amend a delivery address

should be submitted immediately through Shopify or by email.

I will make reasonable efforts to accommodate a change, but I cannot guarantee that an order can be changed or cancelled after production has begun.

This operational limitation does not remove a statutory withdrawal right or other mandatory cancellation right that applies to your purchase.

Where a personalized or custom product has already entered production, cancellation may be unavailable where permitted by applicable law.

16. Incorrect addresses and failed delivery

You are responsible for providing a complete and accurate delivery address.

Contact me immediately if you discover an address error. I will try to update the address where operationally possible, but changes cannot be guaranteed after production or shipping has begun.

Where delivery fails because:

  • the address supplied was incorrect or incomplete;

  • the parcel was not collected;

  • delivery was refused without a valid legal basis;

  • required local delivery information was not supplied; or

  • customs or import charges were not paid,

I may charge reasonable reproduction, return or reshipping costs where permitted by applicable law.

This does not apply where the delivery problem was caused by me, Printify, a print provider or a carrier for whom I am legally responsible.

17. Lost or delayed shipments

Contact me if tracking indicates that a shipment is lost or if it has not arrived within a reasonable time after the estimated delivery period.

I may investigate the matter with Printify, the print provider and the carrier.

Depending on the circumstances and applicable law, I may:

  • send a replacement;

  • reproduce the product;

  • issue a refund; or

  • provide another appropriate remedy.

Customs processing, international transport disruption and local carrier delays may affect estimated delivery dates.

Nothing in this section limits mandatory rights concerning late or failed delivery.

18. Customs duties and import charges

Because Printify uses an international network of print providers, a product may be manufactured domestically or may cross an international border.

You may be responsible for:

  • customs duties;

  • import taxes;

  • brokerage fees;

  • local handling fees; and

  • other charges imposed by authorities or carriers.

Where required, applicable taxes or charges may be collected at checkout. In other cases, they may be collected from you on import.

Unless applicable law requires otherwise, charges imposed independently by customs authorities, carriers or other third parties are not refundable by me.

Refusing delivery solely because import charges are payable does not automatically create a right to a full refund.

Where a refused shipment is returned or becomes unrecoverable, I may deduct legally recoverable return, customs, shipping or handling costs.

Mandatory consumer rights remain unaffected.

19. Products excluded from change-of-mind withdrawal

A statutory withdrawal right may not apply where an exclusion is permitted by applicable law.

For EU/EEA consumers, relevant exclusions may include:

  • goods made according to the customer’s individual specifications;

  • clearly personalized or commissioned goods;

  • sealed goods unsuitable for return for health-protection or hygiene reasons once unsealed;

  • goods liable to deteriorate or expire rapidly;

  • goods inseparably mixed with other items after delivery; and

  • other goods expressly excluded by applicable law.

An exclusion will be identified before purchase where applicable.

A product is not excluded merely because it is printed or produced only after an order is placed.

20. Digital products and electronic artwork

Digital products include electronic artwork, downloadable artwork, digital prints, image files, templates and similar electronic content.

Because a downloaded file can be retained, copied or duplicated, I do not offer voluntary change-of-mind refunds for digital products after electronic delivery has begun.

For EU/EEA consumers, the statutory withdrawal right for digital content expires only where:

  1. you expressly consent to me beginning delivery before the end of the applicable withdrawal period;

  2. you acknowledge that you lose your statutory withdrawal right once delivery begins; and

  3. I begin supplying the digital content.

Once these conditions have been fulfilled and the download, access link or other electronic delivery has begun, you may not cancel merely because:

  • you changed your mind;

  • you no longer require the file;

  • you selected the wrong digital product;

  • you have not opened or used the file; or

  • you state that you have not copied it.

Where required by law, I will provide confirmation of your consent and acknowledgment in your order-confirmation email or on another durable medium.

If you do not provide the required consent and acknowledgment, immediate delivery may not be available. Delivery may be postponed until the applicable withdrawal period expires.

For customers outside the EU/EEA, digital-product purchases are also final after delivery begins, except where a refund, cancellation or other remedy is required by mandatory local law.

21. Problems with digital products

The no-change-of-mind rule does not affect your rights where a digital product:

  • is not supplied;

  • cannot be downloaded;

  • is corrupt or incomplete;

  • is supplied in the wrong format;

  • materially differs from its description or preview;

  • cannot be used because of a problem attributable to me; or

  • otherwise fails to meet mandatory conformity requirements.

Contact me through Shopify or at [CUSTOMER-SERVICE EMAIL] and include your order number and a description of the problem.

I may first attempt to:

  • restore download access;

  • provide the correct file;

  • provide a functioning replacement file;

  • correct the content; or

  • offer reasonable technical assistance.

Where required by applicable law, you may be entitled to a price reduction, contract termination, a full or partial refund or another statutory remedy if the problem cannot be remedied within a reasonable time or is sufficiently serious.

22. Marketplace purchases

If you purchase one of my products through a third-party marketplace, the marketplace’s mandatory return, refund or dispute procedures may also apply.

You may be required to submit a request through the marketplace account used to place the order.

Where applicable marketplace rules provide rights beyond this policy, I will comply with those rules where they govern the transaction.

Marketplace rules do not reduce mandatory consumer rights.

23. Voluntary returns

Unless expressly stated on a product page or marketplace listing, I do not provide a voluntary return period beyond applicable statutory rights.

Any refund, replacement, exchange or store credit granted as a gesture of goodwill does not create an obligation to provide the same remedy in another case.

24. Business customers

Statutory consumer withdrawal rights generally do not apply to customers purchasing primarily for business, commercial or professional purposes.

Returns by business customers are accepted only where:

  • required by applicable law;

  • expressly permitted on the product page; or

  • agreed by me in writing.

Mandatory rights concerning defective or incorrectly supplied products remain unaffected.

25. Governing law and mandatory consumer protection

To the extent legally permitted, contracts with me and this policy are governed by the laws of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods.

This choice of law does not deprive consumers of mandatory protections provided by the law of the country in which they habitually reside where those protections apply regardless of the chosen law.

Nothing in this policy restricts a consumer’s right to bring proceedings before a court that has jurisdiction under applicable consumer-protection or private-international-law rules.

26. Changes to this policy

I may update this policy from time to time.

The version generally applicable to an order is the version made available when the order was placed, unless a later change is required by mandatory law or is more favorable to the customer.
